This Privacy Policy describes how we collect, use, disclose, and safeguard information when you visit www.wellslegal.org (the “Site”), submit forms or messages to us, call or email us, book a consultation through a scheduling link we provide, or otherwise interact with us online.

This Policy applies to information collected through the Site and related online communications. It does not replace attorney-client confidentiality, the Utah Rules of Professional Conduct, or any engagement agreement that may govern how we handle client confidential information in the course of a legal matter. If you become a client, additional confidentiality and data-handling obligations apply under Utah law and professional ethics rules.

The Utah Consumer Privacy Act (UCPA), Utah Code Ann. §§ 13-61-101 et seq., applies to certain businesses that meet statutory thresholds related to annual revenue and volume of Utah consumers’ personal data. Whether or not W&A is a “controller” under the UCPA at any given time, we aim to handle website personal data responsibly and transparently.

If the UCPA applies to us with respect to your personal data, Utah consumers may have rights to confirm whether we process their personal data, access that data, delete personal data you provided to us, and obtain a copy of personal data you previously provided in a portable format, subject to exceptions in the statute (including data processed in the context of employment or certain professional services, and other statutory exemptions).

7. Attorney-Client Communications and Confidentiality

Submitting information through the Site, scheduling a call, or contacting us does not by itself create an attorney-client relationship. Do not send confidential information about a legal matter until we have confirmed that we can represent you and that no conflict prevents representation.

Once an attorney-client relationship exists, confidential client information is protected by applicable privilege and the Utah Rules of Professional Conduct, which may impose duties that are stricter than this website Privacy Policy.

8. Data Retention

We retain personal information for as long as needed to fulfill the purposes described in this Policy, provide services, comply with legal and ethical recordkeeping obligations (including client file retention under professional rules and applicable law), resolve disputes, and enforce agreements. Retention periods for legal matter files may be longer than for ordinary website inquiry records.

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission over the Internet or electronic storage is completely secure. We cannot guarantee absolute security of information transmitted to or through the Site.

10. Children’s Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe we have collected such information, contact us and we will take appropriate steps to delete it.

11. Do Not Track

Some browsers offer a “Do Not Track” signal. There is no uniform industry standard for responding to such signals. Our Site may not respond to Do Not Track browser settings.
