Property Disputes

Select disputes involving boundaries, easements, access, encroachments, title, and other property-rights issues.

Who we represent

W&A represents property owners in select property-rights disputes. This is an additional practice, not a full-service real estate, closing, or listing practice. We serve clients throughout Utah, with a strong presence in Utah County, Park City, and Wasatch County.

What these disputes involve

The matters we take involve boundaries, easements and access, encroachments, title and ownership, quiet title, and related property rights. A typical file starts with a survey, a fence, a driveway, a deed description, or a disagreement about who may use the land.

How we can help

We review the deeds, surveys, and recorded documents, then help you decide whether a conversation, a recorded agreement, a demand, or a court action is the practical next step. When a dispute cannot be resolved, we pursue or defend the claim. We do not handle closings or routine transactional real estate work.

Boundary Disputes

A boundary dispute usually starts with a survey, a fence, a deed description, or a neighbor using land you believe is yours.

We review the deeds, surveys, and recorded documents, then help you decide whether the practical next step is a conversation, a recorded agreement, or a claim to establish the line.

Easements & Access

Access problems arise when a driveway, road, utility line, or other use of land is disputed — whether the easement is written, implied, or claimed by long use.

We help property owners understand what the documents allow, what can be negotiated, and when a court needs to decide who may use the land and on what terms.

Encroachments

An encroachment is a structure, fence, landscaping, or other improvement that crosses the line. The question is often whether it should be moved, licensed, or addressed through a boundary adjustment or damages.

We evaluate the survey, the improvements, and the available remedies before the dispute hardens into a lawsuit.

Title, Ownership & Quiet Title

Title and ownership disputes can involve competing claims, gaps in the chain of title, unreleased interests, or uncertainty about who actually owns the property.

Where appropriate, a quiet-title action can ask the court to determine ownership and clear the record so the property can be used, sold, or financed.
