Fabiana Wells
Founder & Attorney At Law

Fabiana Wells is the founder of W&A, PLLC, a Utah law firm focused on construction disputes, business and contract disputes, and select property disputes. She is admitted to practice law in Utah. She represents homeowners, general contractors, subcontractors, businesses, and property owners in matters involving defective or incomplete construction, payment and performance disputes, breach of contract, commercial collections, boundaries, easements, and related litigation.
Fabiana also advises businesses before disputes arise, including contract drafting and review and ongoing outside general counsel services.
Her approach is practical and direct. She works to identify what the contract actually requires, what the evidence can prove, what the dispute is realistically worth, and what path makes sense for the client. Sometimes that means a focused demand or negotiated resolution. Other matters require litigation.
An International and Unconventional Path to Law
Fabiana is originally from Germany. She came to the United States for college and ultimately made Utah home.
Her path to becoming an attorney was not a traditional one. Before law school, she studied vocal performance in Hollywood and earned a Bachelor of Music in Commercial Music, magna cum laude, from Snow College. That background gave her an early interest in contracts, copyright, business, and the practical problems that arise where creative work and commercial relationships intersect.
She later earned her Juris Doctor from the J. Reuben Clark Law School at Brigham Young University, where she was on the Dean’s List and participated in moot court, student government, and the International Center for Law & Religion Studies. She also studied International Business Law at Central European University in Budapest.
Her legal training included work with the Utah Attorney General’s Criminal Appeals Division, the Utah County Attorney’s Office, and private law firms in Utah, New York City, and Germany.
Litigation & Dispute Resolution
Fabiana’s practice has included civil litigation, contract enforcement, business disputes, construction matters, collections, and settlement negotiations.
She has handled matters from the earliest stages of a dispute—reviewing contracts, correspondence, property records, and payment histories—through demand letters, pleadings, motion practice, negotiation, and litigation. She also drafts and reviews contracts and provides other preventive counsel so issues can be addressed before they become disputes.
In 2026, Fabiana represented the appellant in Taylor v. Lawlor, 2026 UT App 118, a published Utah Court of Appeals decision in which the court reversed the dismissal of her client’s case and remanded it for further proceedings.
She brings the same litigation perspective to preventive work. When reviewing or drafting a contract, the question is not simply whether the agreement looks complete today, but what happens if payment stops, performance breaks down, the scope changes, or the parties no longer agree about what the contract means.
Writing & Scholarship
Fabiana has also written on legal issues outside her day-to-day practice.
Her published scholarship includes work on international law and the Yemeni civil war, comparative cybercrime legislation in Germany and the United States, and music copyright and blanket licensing:
- Aiding and Abetting War Crimes in the Yemeni Civil War: U.S. Involvement
Journal of Global Rights and Organizations, Vol. 10, p. 104 (2019)
- Hacked off: How Germany and the United States Are Dealing with the Continuous Threat of Cyber Attacks
National Security Law Brief, Vol. 10, No. 1 (2020)
- The Necessity of Blanket License Agreements in Light of 17 U.S.C. 110(4) Unveiled
UCLA Entertainment Law Review, Vol. 27, No. 1, p. 19 (2020)
That range reflects a career that has crossed different industries, jurisdictions, and areas of law—but the common thread has remained the same: understanding complicated facts, identifying the rules that matter, and turning them into a practical strategy.
